Ordering

You are responsible for supplying all required information when submitting an order, including complete name, shipping and billing address (no P.O. Boxes), telephone number, valid e-mail address, and valid payment method. No responsibility is assumed for mis-delivery due to incorrect information supplied by a customer. Johnny McGuire Photography reserves the right to refuse or cancel any order at any time, in which case the customer’s sole remedy is a refund of any payment(s) made for such order.

Changes

It is not possible to change your order once it has been placed. The only exception is the delivery address, which can be changed if your order has not yet been shipped. To change the address for an unshipped order, please contact me via email jm.creative.visuals@gmail.com

Payment

Full payment is required at the time of purchase. We accept the following payment methods:

  • Credit Cards (Visa, Mastercard, American Express, Discover)

  • Apple Pay

  • Google Pay

  • Any additional payment methods we may introduce in the future

If a payment is declined, stopped, or fails to process for any reason, Johnny McGuire Photography reserves the right to cancel the order. If an order has already been shipped, the customer remains responsible for full payment. Johnny McGuire Photography may pursue collection efforts, including but not limited to reasonable attorneys’ fees, collection agency costs, and interest charges of 1.5% per month (or the highest allowable rate by law, if less).

By making a purchase, you agree to abide by these payment terms. If you have any questions about your payment method, please contact me before completing your order.

General

Descriptions, images, references, features, content, specifications, products, price and availability of any products or services are subject to change without notice, and our current prices can be found on our Sites and Apps. No responsibility is assumed for any errors in listed prices or other information, all of which we reserve the right to correct. Orders are not final or binding until accepted by us. We reserve the right, with or without prior notice, to limit the available quantity of or discontinue any product or service; to honor, or impose conditions on the honoring of, any coupon, coupon code, promotional code or other similar promotions; to bar any user from making any or all purchase(s); and/or to refuse to provide any user with any product or service. Johnny McGuire Photography is not responsible for any delay or failure in delivery due to causes beyond its control, including, but not limited to, acts of god, war, terrorism, embargo, quarantine, accidents, fire, explosion, flood, severe weather, epidemic, riots, civil disturbance, unavailability of labor or transportation or any other similar or dissimilar cause. You are responsible for the proper and safe handling of any prints or other products you order from us. To the extent allowed by law, johnnymcguirephotography.com’s liability for any claim relating to any product purchased from us is the amount you paid for the product.


Copyright

While we are not obligated to review User Submitted Materials for copyright infringement, we are committed to protecting copyrights and expect users of our Sites and Apps to do the same. The Digital Millennium Copyright Act of 1998 (the "DMCA") provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that any material used or displayed on or through our Sites and Apps infringes your copyright, you (or your agent) may send us a notice requesting that the material be removed, or access to it blocked. We may use Personal Information about you for purposes described in this Privacy Policy or as otherwise disclosed to you through the johnnymcguirephotography.com online services. This includes the following:

We may disclose your Personal Information to third-party service providers to provide us with services such as website hosting, professional services, including information technology services and related infrastructure, customer service, shipping of prints, e-mail delivery, auditing and other similar services necessary to the johnnymcguirephotography.com online services and services you request.

We may disclose your information to a third party in connection with a corporate reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock, including in connection with any bankruptcy or similar proceedings.

Non-personal information may be used for any purpose not prohibited by law. For example, we may collect, compile, store, publish, promote, report, sell, or otherwise disclose or use any and all information that does not identify an individual (or that has been modified to remove individual identification).

Social Networking and Third Party Sites

When you sign in or link to johnnymcguirephotography.com through any social networking service, such as Facebook, any information you supply (or have supplied) to us becomes subject to the privacy policy of that social network/service. We do not control, and are not responsible for, the privacy practices of such networks or services. You should consult the privacy policy of such networks/services. If you post information in a public forum it becomes public information. The johnnymcguirephotography.com online services may provide links to other sites or services. If you use such other sites or services, check their privacy policies. We are not responsible for the privacy practices of any other site or service.

Children

The johnnymcguirephotography.com online services are not intended for children under the age of 13. We will not knowingly collect any personally identifiable information from children under the age of thirteen (13). If we learn that we have obtained any personally identifiable information about a child under age 13, we will delete that information.

Security

We strive to use reasonable safeguards to help prevent loss, misuse and unauthorized access, disclosure or modification of Personal Information provided or collected through the johnnymcguirephotography.com online services. However, no system is perfect or can guarantee that unauthorized access or theft might not occur.

Retention of Information

We do not retain credit card or other payment information after a transaction is closed. While this means you will need to re-enter your information for each subsequent transaction, it helps reduce risks of sensitive data becoming accessible to unauthorized persons. Following termination of any transactions with you, we will retain other information about your transactions (what you ordered, etc.). Unless you request that your information be deleted by contacting us, we may retain your information for back-up, archival, legal and audit purposes.

Color Matching

You acknowledge and understand that (a) colors as seen on a computer monitor may not look the same as the colors as they appear on our manufactured product, and (b) no guarantee is made that any image as seen online will necessarily match exactly the colors on the final product.

Cancellations

All works are custom orders. Production of the purchased work(s) begins immediately after purchase, and shipment will occur as soon as possible after production is complete. As a result, the work(s) cannot be cancelled, returned or refunded at any time. In light of the substantial production costs incurred once production has begun, any request to cancel an order or otherwise modify the produced image (e.g., increasing or reducing size, changing image, etc.) will be eligible to a 50% restocking fee. Due to our shipping and production timeline, produced & shipped work(s) are non-cancellable, non-returnable, non-exchangeable and non-refundable.
